The District Court has been told the victim of an alleged rape at South Durras last November identified a different person when shown a photo board of possible perpetrators by police.
27-year-old Beaudi Vella from Surfside, who’s free on bail, was yesterday formally committed to stand trial in March next year.
He’s pleaded not guilty to three charges including aggravated sexual assault while depriving liberty.
In Sydney’s Downing Centre District Court Deputy Chief Judge Stephen Hanley asked Vella’s lawyer “There was a photo board ID where a different person was selected. I assume you want that in don’t you?” to which he responded “Yes.”
The court was told the trial is expected to take up to seven days to complete.
It will commence on March 1 in Bega District Court.
