An accused rapist has been released on bail after sitting in jail on remand since his arrest four months ago.
Beaudi Vella was successful on his second attempt to be freed while he awaits trial over the alleged incident at South Durras in which police allege caused serious injury to the victim.
Batemans Bay Local Court has been told Vella suffers from a heart condition that has killed one of his brother and a cousin that requires urgent medical care not available to him behind bars.
His lawyer also told the court the 27-year-old has been bashed twice since entering prison.
As part of his release Magistrate Doug Dick set a number of conditions. Vella must live with his mum at West Wyalong, not leave the house unless with his mum or her partner, stay at least 200km’s away from Batemans Bay, report to police daily.
His mum also told she will have to pay $5000 if he fails to comply.
The case returns to court on May 4.
