A man has been freed from jail to go directly to rehab while he faces several domestic violence and assault charges.

Batemans Bay Local Court has been told Christopher Kenny is a repeat offender who has continually breached various intensive and community corrections orders.

He asked the court to be released on bail so he could be admitted into a residential rehab facility to finally deal with his addiction issues.

Police opposed the application stating “this is a person who has been ordered to do this twice before and will just say anything to get out of jail.”

“He was in jail for a good reason and posed a threat to the victim”, who was in the public gallery.

His lawyer Daniel Turner agreed with police that the penny should have dropped earlier for his client.

Mr Turner argued Kenny was aware if he fails again, it meant a fulltime jail sentence.

Magistrate Doug Dick told the court it is a very fine line balancing exercise before freeing him on the condition that he go from prison directly the rehab facility.
