Batemans Bay cop guilty of assaulting teens during arrests

A police officer has escaped a jail sentence after being convicted on three counts of assault while on duty.

37-year-old Brett David Lindsay faced a two-day hearing in Batemans Bay Local Court over the incidents at the former Beach Drive Motel in November 2023.

In the witness box the Senior Constable stated his actions, including punching one of the juveniles in the collarbone area while on the ground, were moderate and within police guidelines.

But Magistrates Doug Dick found It was a use of force no reasonable police officer would have used in the circumstances.

Lindsay has been placed on a Community Corrections Order for two years including undergoing mental health treatment.
