The NSW Land and Environment Court has dismissed an appeal by a Coolagolite land owner against Bega Valley Shire Council to allow a couple to live in a tiny house on wheels on his property.
In the highly technical judgment handed down yesterday, Commissioner Elizabeth Espinosa ruled while she is satisfied the tiny fits the definition of a caravan and can be relocated, it also is required to subjected to planning approval for the Brimmers Lane site.
She revoked the council’s Demolish Works Order but rejected the appeal by Gordon Kelly against the Stop Use Development Control Order.

The ruling comes as a double blow to the tiny homeowners Joshua and Manu who were recently given 30 days to leave the property by Mr Kelly.
